Lidia practices in commercial litigation and dispute resolution with a focus on property disputes, retail and commercial leasing disputes and complex commercial and contractual disputes.

Lidia acts for landlords and managers of shopping centres, owners of commercial premises, retailers, developers and other business enterprises on a variety of complex legal matters.

Lidia’s experience extends across a range of Tribunals, Federal and State Courts. 

Experience

Lidia’s recent experience includes:

• acting for a major landlord in a successful $2.1 million claim in the NSW Supreme Court against a lessee and two guarantors, for breach of lease, in particular the recovery of rental arrears in light of the NSW Retail and Other Commercial Leases (COVID-19) Regulations (NSW) and the National Cabinet Mandatory Code of Conduct – SME Commercial Leasing Principles During COVID-19
• acting in a successful Appeal to the Full Court of the Federal Court of Australia in a misleading and deceptive conduct claim regarding the sale of a shopping centre resulting in a favourable judgment and an award of costs
• advising on and acting for retail/commercial landlords in recovering rental arrears, taking possession of leased premises and pursing former lessees for breach of lease and loss and damage following termination of a retail/commercial lease
• acting for a landlord/developer in a successful claim in NCAT for recovery of rental arrears and loss and damage following termination of a retail lease
• advising on and managing winding up proceedings.
