Hayley is a senior associate in the Melbourne Dispute Resolution and Litigation team. Hayley has extensive experience in large-scale, complex commercial litigation.

Hayley acts for large corporations, company directors, government departments, insurers, and individuals. Hayley’s areas of practice include contractual disputes, white collar crime, class actions, directorial liability and corporations law, misleading and deceptive conduct, product liability, and appellate proceedings.

Hayley has multi-jurisdictional experience, having acted for her clients in proceedings in the Federal Court of Australia, the Supreme Court of Victoria, the Supreme Court of New South Wales, the Supreme Court of Queensland, and the Supreme Court of Western Australia.

Experience

Hayley has acted in a number of high-profile and large-scale disputes, including:

  • acting for a ‘Big 4’ bank in defence of class action proceedings brought under the National Consumer Credit Protection Act 2009 (Cth)
  • acting for individuals and companies in defence of insider trading allegations, including in proceedings brought by a liquidator against a former majority shareholder and its nominee directors seeking in excess of $180 million in damages
  • acting for a multi-national aviation company in a $1 billion breach of contract and misleading and deceptive conduct claim
  • acting for multiple directors in defence of alleged breaches of directors’ duties following the collapse of an ASX-listed company with a previous market capitalisation exceeding $350 million
  • acting for a multi-national pharmaceutical company in a product liability class action
    • this matter involved alleged breaches of the Australian Consumer Law with respect to the popular weed killer, Round Up
  • acting for an Australian technology developer in a cross-border contractual dispute concerning the supply of millimetre wave radio links for use in relation to the NYSE, the Nasdaq, and the Chicago Board Options Exchange
  • advising in relation to various investigations, including investigations conducted by ASIC and state Government departments
  • various professional indemnity and management liability claims, including for large insurers
  • advising company directors in relation to directors’ and officers’ policy coverage.

Hayley has also advised a multi-national investment banking and financial services group in relation to anti-bribery and corruption laws and has provided strategic advice to the Department of Defence.
