Daniel is an accredited specialist in commercial litigation law and has acted for corporate and individual clients in wide range of commercial disputes and complex litigation in all Victorian Courts, the Federal Court and VCAT.
Daniel also has extensive experience in regulatory prosecutions and white collar crime having conducted numerous prosecution proceedings for Councils and statutory agencies, as well as defending companies and directors in regulatory prosecutions and investigations.
Daniel also has experience in class action proceedings and is well versed in acting for clients across a range of industries including agribusiness, financial services and resources.
Daniel is experienced in the following areas:
Property litigation including adverse possession, constructive and resulting trust claims, retail leasing, sale of land disputes, caveats and owners corporation matters including recently successfully defending an Owners Corporation and over 30 lot owners in Supreme Court proceedings brought by a letting agent.
Agribusiness disputes including family farming partnership and property disputes, disputes over farm leases, water and land and acting for several of Victoria’s largest potato producers in contractual disputes with processors.
Banking and finance disputes including acting for banks and commercial lenders in enforcing mortgages, finance contracts and equitable charges and providing advice on Commonwealth regulatory legislation.
Competition and consumer law including goods and services claims in VCAT and successfully defending Direct Chemist Outlet in Federal Court passing off proceedings brought by Chemist Warehouse.
Regulatory prosecutions including conducting prosecutions and providing enforcement advice for numerous municipal councils under the Domestic Animals Act 1994, Food Act 1984, Planning and Environment Act 1987, Building Act 1993, Local Government Act 1989 and Local Laws, such as prosecuting a large-scale puppy farm involving 70 dogs and 129 charges, in a joint prosecution with the RSPCA.
White collar crime such as recently defending a large material recycler and its director against charges brought by the EPA, acting for farming companies and landowners in prosecution proceedings brought by water authorities.
Class actions in acting on behalf of dairy farmers in the Fonterra Class Action from 2020 to 2023.
