Expertise

Sally practises in construction and infrastructure law and has extensive experience working in the resources, energy and projects, real estate and government sectors. 

Sally has acted for a range of clients in dispute resolution, ranging from large-scale court proceedings, domestic and international arbitration, through to bespoke alternative dispute resolution mechanisms including expert determination and mediation.  She also has extensive experience in acting for both principals and contractors in security of payment adjudications and reviews of adjudication decisions.

Sally has also advised on a number of project delivery models and has assisted developers and contractors with contract drafting, negotiation and administration on projects across Australia.  Sally’s experience allows her to assist her clients in the management of projects throughout their lifespan, including risk management and resolution of disputes that can arise throughout.

Sally’s recent experience includes:

Disputes

  • acting for a Queensland-based developer for a mixed residential and commercial project in Supreme Court proceedings to set aside an adjudication decision for want of jurisdiction. Sally has acted for the same developer in an originating application seeking interim and final injunctive relief in Supreme Court of Queensland
  • acting for a civil contractor in an adjudication related to encountered latent conditions, including acting for the same civil contractor in responding to an application to set aside the adjudication decision for jurisdictional error
  • acting for a contractor in a confidential international arbitration regarding claims for defective design and construction and fit for purpose claims related to port operations and pavement design in excess of AUD $60 million
  • acting for a large mining contractor in a confidential expert determination regarding variations and standby claims associated with a coal mine, as well as confidential arbitration proceedings concerning equipment hire
  • acting for a tier 1 EPC contractor in court proceedings in Western Australia in relation to a design subcontractor at a mining site, as well as a range of other disputes on mining sites for this client
  • acting for a WA-based power and communications infrastructure contractor for various disputes in relation to renewable energy sites and claim preparation.

Front-end

  • acting for a large civil works contractor updating its full suite of construction related documents including vendor contracts, minor works contracts, supply contracts and maintenance contracts, as well as conducting regular reviews and negotiating departures for its client contracts
  • regularly advising a major water infrastructure contractor on procurement and negotiation of various construction and design agreements ranging across the east coast for governmental departments, local councils and the private water sector
  • regularly acting for private developers in the preparation and negotiation of construction contracts for residential and commercial developments across Queensland
  • advising the Brisbane Lions in relation to the construction of the Springfield Stadium, a $70 million boutique football stadium including assisting with advising on structure and preparing construction contracts and advising on various stages of the project
  • advising the Queensland Reds in relation to the Ballymore redevelopment project, including assisting with preparation of all relevant tender and contract documentation for the project
  • preparing due diligence reviews and assisting the transaction team in the acquisition of a major water infrastructure contractor for existing projects across the east coast for governmental departments, local councils and the private water sector.
