Quinn has experience in the building and construction industry, with a particular focus on major infrastructure project disputes and litigation. Her work has involved technically complex matters across a range of project settings, including environmental conditions affecting sewage treatment infrastructure and harmonic disturbances impacting solar farm operations.

Quinn advises on technically complex disputes arising from design and construction contracts, engineering, procurement and construction contracts, and major road infrastructure projects. She also has experience in adjudications under security of payment legislation.

Experience

Quinn’s recent construction dispute experience includes:

  • advising the Queensland Department of Transport and Main Roads (TMR) on a range of design and construction disputes arising from major infrastructure projects
  • acting for an EPC contractor in a confidential international arbitration concerning claims for defective works and fitness for purpose issues relating to a solar farm project
  • acting for a Queensland property developer in Supreme Court proceedings to set aside adjudication decisions for want of jurisdiction, including acting in applications to the Court of Appeal
  • acting for owner in District Court proceedings against a builder for overpayments made under a residential contract and misleading and deceptive conduct claims under the Australian Consumer Law
  • acting for principals and contractors in the preparation of adjudication applications, adjudication responses and associated materials under security of payment legislation
  • acting for a state-owned utility services company in Supreme Court proceedings concerning alleged breaches of a design and construction contract and claims of misleading or deceptive conduct under the Australian Consumer Law
  • acting for a joint venture in relation to the operation of Annexure D and Annexure E of the Transport Infrastructure Contract – Construct Only (TICO) contract, including preparing long-form claims addressing time and cost impacts arising from COVID-19 and market disruptions that caused significant material cost escalation
  • advising a civil contractor on prescribed rise and fall mechanisms under a TICO contract, including the interaction between Annexure D and Annexure E and claims for increased costs arising from quarry closures, labour shortages and material shortages.
