Expertise

Emily has acted for major contractors, engineering firms and project owners (including government) on a number of high profile projects across the public infrastructure, renewable energy and commercial construction sectors.

She has extensive experience acting in court proceedings and other forms of dispute resolution, including mediations, expert determinations and security of payment adjudications, as well as in drafting and negotiating contracts for major infrastructure projects, renewables projects and commercial developments.

She works with clients at all stages of the project lifecycle to identify and manage risk, implement effective contract administration and dispute avoidance strategies, and resolve claims and disputes.

Emily has been named as One to Watch in the inaugural 2023 edition and the 2024 and 2025 editions of The Best Lawyers in Australia in the categories of Construction & Infrastructure Law and Alternative Dispute Resolution. In 2022, she was recognised by Australasian Lawyer as a Rising Star and was a finalist in Lawyers Weekly’s 30 Under 30 in the category of Construction & Infrastructure.

Disputes and project delivery advice

  • acting for an engineering firm in multi-party proceedings in the Queensland Supreme Court involving claims in respect of allegedly defective work on a major road project
  • acting for the head contractor in major litigation in the WA Supreme Court involving claims for damages and delay costs (as well as a counterclaim for liquidated damages) on the Perth Airport Terminal 1 Domestic Pier and International Departures Expansion project
  • acting for the head contractor on a sewerage treatment plant project in Queensland in upstream disputes (including a security of payment adjudication for delay costs arising from a lengthy suspension of work) and downstream disputes (including an expert determination against the structural engineer) 
  • acting for the supply, operate and maintain contractor on ongoing claims and contract management on the Parramatta Light Rail project 
  • advising the operate and maintain contractor on claims in connection with cracking discovered in light rail vehicles on the Sydney Light Rail PPP project
  • advising a multinational wind turbine supplier on the delivery of multiple wind farm projects across Queensland and NSW (including in anticipation of its civil works consortium partner entering into administration) 
  • advising a multinational power generation developer on ongoing claims, contract management and disputes on wind farm projects in Victoria.

Transactions

  • advising Queensland Health on two-stage management contractor contracts for the Capital Expansion Program
  • reviewing and negotiating large-scale facilities maintenance contracts for government-owned assets (including the NSW Country Rail Network) while on secondment with Ventia 
  • preparing and negotiating refurbishment and expansion contracts for luxury car dealership and lifestyle precincts across Australia
  • preparing a suite of tender-issue documents including EPC and O&M contracts for the Mornington 240MWh Battery Energy Storage System project 
  • advising a solar panel supplier on its bid to be appointed as the EPC Contractor for the Wollar Solar Farm in NSW 
  • advising a large infrastructure contractor on its successful bids for the Sydney Road Assets Performance project and Parkes Special Activation Precinct project in NSW
  • advising a shortlisted joint venture on its bid for Warringah Freeway Upgrade project in NSW
  • advising a global investment fund on its bid to acquire a publicly listed company with a portfolio of wind and solar farms.
