Scott has over 12 years of global experience advising on all aspects of construction, energy and infrastructure. 

His experience in advising clients in all areas of the project life cycle (from structuring, risk allocation and tendering through to negotiation, project delivery and disputes) allows him to deliver trusted, practical and timely solutions. 

Experience

Scott has advised a number of domestic and international clients (both in private practice and as general counsel) in relation to matters of critical importance to their businesses.

Some of Scott’s recent construction, infrastructure and energy experience include:

  • Advising on and negotiating several major traditional and project-financed energy projects such as RES’ 400MW Murra Warra wind farm and Rio Tinto’s 600MW Oyu Tolgoi coal power station in Australia, Mongolia and Vietnam (including construction, service, BOP, security and associated contracts)
  • Advising Vestas and Senvion on seven long term energy plant operation and maintenance agreements in Australia and Japan incorporating complex performance guarantee regimes
  • Advising Symbior Solar Siam on the leasing of land for the construction of a 50MW PV solar power station together with associated security arrangements
  • Advising Monadelphous and Bechtel on OHS obligations and management of critical incidents
  • Drafting several suites of procurement and services contracts for Newcrest Mining, Qantas and Port of Melbourne as well as negotiating a wide range of bespoke and standard form supply and procurement agreements
  • Managing project life cycle disputes including the issue and return of performance securities, management of variations and resolving defect liability period obligations
  • Advising Wagner in relation to the restructuring $30M in non-performing loans for mining equipment
