Rachel is a planning and environment lawyer with extensive experience in the local and state government spheres. She has worked closely with local and State government authorities, assisting them with planning, environment, compulsory acquisition, building, local laws, environmental health, general property, and administrative law matters.

Experience

Rachel’s experience includes:

  • advising local and State government authorities on compliance with their statutory obligations, best practice, and the exercise of statutory powers
  • advising local governments and private clients in relation to planning matters, including land uses, enforcement and compliance with Acts, planning schemes, permits and agreements, and contaminated land issues
  • acting for local and State government agencies and private clients in enforcement, declaration, and review proceedings in the Victorian Civil and Administrative Tribunal, including with respect to:
    • unauthorised use and development of land and destruction of native vegetation
    • existing use rights and characterisation of use issues
    • amenity issues relating to noise, odour, and appearance
    • reviews of decisions to grant and refuse permits, works approvals, amendments and extensions of time.
  • advising on environmental duties and compliance with environmental legislation 
  • prosecuting planning, building, local laws, and environmental matters on behalf of local governments in the Magistrates’ Court
  • acting for and advising local and State government authorities in compulsory acquisition matters and general land acquisition, including litigated matters in the Victorian Civil and Administrative Tribunal and Supreme Court of Victoria
  • devising policies and training programmes and advising on administrative decisionmaking, and acting for local governments in merits and judicial review proceedings
  • reviewing and drafting strategic and governance documents, local laws, policies, and procedures 
  • drafting and advising on permits, planning scheme amendments, and section 173 agreements, including those which provide for road works contributions, the delivery of road infrastructure projects, and regulate the use and development of land.
