Litigation guardian appointments

  • Ainsley has been appointed as an independent litigation for minor beneficiaries in both family provision applications and informal will applications to ensure the minors interests are properly represented.

Constructive trusts and promissory estoppel

  • acting for a disappointed party where an interest in land was promised but the testator failed to put into effect the promise on their death.

Enduring powers of attorney

  • acting for executors where attorneys have not properly accounted for funds during their appointment.

Family provision applications

  • acted for a widow for a long term second marriage where her distribution of a large estate was left in trust without any control. Successfully negotiated a positive outcome at mediation, avoiding ongoing litigation and significant legal fees.

Letters of administration

  • acted for two young daughters of the decreased. Provided urgent advice regarding the ongoing operation of the company and successfully resolved the de facto’s claim without litigation commencing. 

Complex estate administration

  • acted for executors of an estate where business loans were secured by personal property as well as third party guarantors. Provided advice to the executors in circumstances where the estate and business had limited funds and additional funds were required from the third party guarantor to satisfy he bank loans. The executors were able to negotiate arrangement between the bank, guarantor and a disappointed surviving spouse.
